Holt’s out of the Legislature?

This news I heard here first:

The Erie County Attorney has issued an opinion that the 3rd District County Legislature seat is vacant. The vacancy occurred automatically upon Legislator George A. Holt, Jr.’s guilty plea to a crime that is a violation of the Legislator’s Oath of Office.

Pursuant to New York Public Officers Law Section 30, every public office shall become vacant upon the officer’s conviction of a crime involving a violation of the Oath of Office. A violation of the Oath of Office consists of many things, including knowingly giving false statements. On January 8, 2007, Legislator Holt pleaded guilty to violating New York State Tax Law and admitted to filing false tax statements. Thus, according to New York State Public Officers Law, the 3rd Legislative District seat automatically is vacant.

The Erie County Attorney, pursuant to Section 602 of the Erie County Charter, is the legal adviser to the County Legislature on matters pertaining to its officers. The Erie County Legislature, under the chairmanship of Legislator Lynn M. Marinelli, will follow the opinion of the County Attorney and will faithfully act pursuant to New York State Law. As such, action will be taken to strike every legislative action taken by the Legislator of the 3rd District subsequent to his guilty plea on January 8. The Legislature has also realigned its committees to compensate for the vacancy. The business of government will continue without interruption.
